1. About these Terms
These Terms are between Halloterra (Pty) Ltd, registration number 2026/154512/07, which operates Amigomap as a trading name and business division ("Halloterra", "Amigomap", "we", "us" or "our"), and the person or organisation using the Amigomap website or service.
If you create or administer an account for a business or organisation, that business or organisation is the "Customer" and you confirm that you have authority to bind it. An individual permitted to use a Customer account is an "Authorised User". People who view a published map or submit content without holding a Customer account are "Public Users".
By creating an account, accepting an order, using the service, viewing a published map or submitting content, you agree to the provisions of these Terms that apply to your activity. If you do not agree, do not use the service.
2. The service
Amigomap is a SaaS mapping and experiential platform. Depending on the selected plan and enabled features, it may allow Customers to create, edit, save, publish, embed and share interactive maps; add routes, tracks, markers, labels, images and logos; control access; receive visitor comments or photographs; and use related mapping, presentation and administration features.
Features, plan limits and technical behaviour may evolve. The current plan description, order summary and any written enterprise order form form part of these Terms. If there is a direct conflict, a signed enterprise order form takes priority for that Customer, followed by the checkout or order summary, then these Terms.
3. Eligibility and business use
The paid Amigomap service is intended primarily for businesses and organisations. A person creating an account must be at least 18 years old and legally capable of entering into a contract.
A Customer is responsible for its Authorised Users, administrators, account settings, invitations and use of the service. A Customer must ensure that each Authorised User complies with these Terms and the Acceptable Use Policy.
4. Accounts and security
- Provide accurate, current account and organisation information.
- Keep login credentials and authentication methods confidential.
- Do not share individual accounts except through Amigomap's approved invitation and user-management features.
- Promptly remove access for people who no longer require it.
- Notify us promptly at the support address if an account or credential may have been compromised.
The Customer is responsible for activity performed through its accounts unless the activity results directly from Halloterra's breach of its obligations.
5. Plans, trials and usage limits
Each plan may include limits or conditions relating to the plan live period, published-map loads or views, number of users or seats, publishing modes, storage, features, video generation, domains, support or other usage. These limits are shown on the pricing page, checkout, order summary or Customer account.
Usage is measured by Amigomap's systems. For example, a published-map load may be counted when Amigomap successfully admits and delivers the map data required to render that map. Repeated or abusive requests may be limited or blocked.
When a plan expires, is paused, reaches a hard usage limit or otherwise becomes ineligible, Amigomap may restrict creating, opening, saving, publishing, viewing, embedding or other plan-dependent actions until the Customer renews, extends, upgrades or resolves the issue.
A free trial may be limited by time, usage, users and features. Trial eligibility is determined by Halloterra. A person or organisation may not create multiple accounts, identities or entities to obtain repeated trials or evade plan limits.
A trial will convert to a paid or recurring plan only where this is clearly disclosed and authorised through the applicable checkout or order process.
6. Orders and Paddle
Where a purchase is completed through Paddle, "Paddle" means the relevant Paddle contracting entity identified in Paddle's Buyer Terms and at checkout. Paddle acts as the merchant of record and authorised reseller for the transaction. The buyer purchases the relevant Amigomap product from Paddle under Paddle's applicable Buyer Terms, while Halloterra grants the right to access and use Amigomap under these Terms.
Depending on the buyer's location, the relevant Paddle entity may currently be Paddle.com Inc., Paddle.com (Canada) Ltd. or Paddle.com Market Limited. Paddle may update its contracting entities from time to time, and the entity identified at checkout and in the applicable Paddle Buyer Terms will govern the transaction.
Paddle processes payments, payment-method information, transaction taxes, receipts, invoicing support and certain refunds or disputes. Halloterra does not ordinarily receive complete payment-card details.
Prices, currencies, taxes, billing periods and renewal information are displayed before purchase. The Customer authorises Paddle to charge the selected payment method as disclosed at checkout.
7. Renewals, cancellation and plan changes
A recurring subscription renews for the period and at the price disclosed at checkout or in a later valid notice unless cancelled before the renewal is processed. A fixed live-period plan ends on its stated expiry date unless extended or replaced.
A recurring subscription may be cancelled through the available Paddle buyer portal or by contacting support. Cancellation normally takes effect at the end of the current paid billing or access period. The Customer remains responsible for charges incurred before cancellation.
Upgrades, downgrades, extensions, top-ups and added users are subject to the options and pricing then offered. A downgrade may require the Customer to reduce users, content, domains or features before it can take effect.
8. Refunds and withdrawal rights
Refunds are governed by the separate Refund and Cancellation Policy, Paddle's applicable buyer and refund terms, and mandatory law.
Because Amigomap offers access to a digital service and may offer a free trial, payments are generally non-refundable once a paid period, fixed live period, extension or top-up has started, except for duplicate or incorrect charges, a qualifying material defect that we cannot remedy within a reasonable time, or where the law requires a refund.
Nothing in these Terms limits a cancellation, cooling-off, refund or other consumer right that cannot lawfully be excluded. Where a mandatory right applies, it prevails over an inconsistent provision in these Terms.
9. Customer Content
"Customer Content" includes maps, geographic information, tracks, routes, markers, labels, text, images, logos, documents, access lists, comments, photographs and other material uploaded, created, selected or submitted through a Customer's use of Amigomap.
As between Halloterra and the Customer, the Customer retains ownership of its Customer Content. The Customer grants Halloterra and its service providers a worldwide, non-exclusive licence to host, copy, store, process, transmit, convert, display, publish, cache, back up and otherwise use Customer Content only as reasonably necessary to provide, secure, support and improve the service, comply with the Customer's instructions, and meet legal obligations.
The Customer confirms that it has all rights, permissions, notices and lawful bases required to upload and use Customer Content, to invite Authorised Users, to identify selected recipients and to publish or embed maps.
10. Public maps, sharing and visitor submissions
A Customer chooses the access mode for a map. A public map may be accessed by anyone who obtains its link and may be indexed, shared, copied, captured or embedded by third parties. Domain-restricted embedding controls where a public map may be embedded; it does not convert a public map into a private map.
Private or selected-access features reduce access but cannot prevent an authorised recipient from taking screenshots, copying information or sharing credentials or content. Customers must not use Amigomap as the sole control for highly confidential, regulated or safety-critical information.
Where comments or photographs are enabled, Public Users must submit only lawful material they are entitled to share. A Customer may moderate submissions. Halloterra may reject, hide or remove content that breaches these Terms, the Acceptable Use Policy, law or a third party's rights.
A Public User grants Halloterra and the relevant Customer a non-exclusive licence to host, process, moderate and display the submitted content for the relevant map experience and related service administration.
11. Mapping accuracy and safety
Amigomap is a communication, visualisation and experiential platform. It is not a surveying, cadastral, emergency-response, aviation, maritime, medical, security, traffic-control or turn-by-turn navigation service.
Maps, routes, elevations, coordinates, basemaps and third-party geographic data may be incomplete, delayed, inaccurate or unsuitable for current conditions. Customers are responsible for independently checking routes, access, permissions, hazards, closures, event arrangements and safety information before publication or operational use.
Do not rely on Amigomap as the sole source of information where an error could cause death, personal injury, property damage, legal non-compliance or material financial loss.
12. Acceptable use
The Customer, Authorised Users and Public Users must comply with the Acceptable Use Policy. Without limiting that policy, no person may use Amigomap to infringe rights, publish unlawful or deceptive material, facilitate harm, introduce malware, probe security, evade access controls, manipulate usage counting, scrape the service excessively or interfere with other users.
13. Third-party services and content
Amigomap relies on third-party services, which may include authentication, hosting, databases, cloud storage, mapping, geocoding, media delivery, email and billing services. Current providers may include Clerk, Mapbox, OpenStreetMap, Cloudinary and Paddle.
Third-party services and data may be governed by their own terms, privacy notices, licences and attribution requirements. Their availability and functionality are not entirely under Halloterra's control.
OpenStreetMap and other map-data attributions displayed by the service must not be removed, hidden or altered except as permitted by the relevant licence.
Third-party names, logos and marks, including Paddle, Clerk, Cloudinary, Mapbox, OpenStreetMap, Google Maps, Waze, Apple Maps and Strava, are owned by their respective owners. References to third-party products or services are descriptive only and do not imply affiliation, sponsorship, certification or endorsement unless expressly stated.
Third-party links and destinations
Amigomap may contain links to or allow users to open third-party websites, applications or services, including navigation services, event websites, sponsor websites, social-media services and websites selected or supplied by a Customer.
Halloterra does not control those independent third parties and is not responsible for their availability, content, accuracy, security, products, services or privacy practices. Accessing a third-party service is at the user's discretion and is governed by that third party's own terms, privacy notice and other policies.
The presence of a link or the ability to open a third-party application does not imply that Halloterra endorses, approves or guarantees that third party or its service.
14. Halloterra intellectual property
Halloterra and its licensors own Amigomap, its software, source code, design, workflows, documentation, branding and all related intellectual-property rights, excluding Customer Content and third-party material.
Subject to these Terms and payment of applicable fees, Halloterra grants the Customer a limited, non-exclusive, non-transferable and revocable right during the applicable plan period to access and use the service for the Customer's internal business and authorised public-map purposes.
No person may copy, modify, reverse engineer, decompile, resell, sublicense, frame or create a competing service from Amigomap except to the extent such restriction is prohibited by law or expressly authorised in writing.
Feedback may be used by Halloterra without restriction or payment, provided that Halloterra does not identify the Customer publicly without permission.
15. Confidentiality
Each party must protect the other party's non-public confidential information using reasonable care and use it only for the agreement. Confidential information does not include information that is public without breach, already lawfully known, independently developed or lawfully received from another source.
A party may disclose confidential information where required by law, after giving notice where legally permitted.
16. Privacy and personal information
Halloterra processes personal information as described in the Privacy Policy.
For account administration, website operation, product support, security and Halloterra's own business relationship with a Customer, Halloterra may act as a responsible party or data controller. For personal information included in Customer Content and processed on the Customer's instructions, the Customer will generally be the responsible party or controller and Halloterra will generally act as an operator or processor.
The Customer must comply with applicable privacy and data-protection laws, provide required notices, obtain required permissions, respond to data-subject requests relating to Customer Content and avoid uploading personal information that is excessive for the intended map experience.
17. Service operation and changes
Halloterra will use reasonable efforts to operate the service, but does not promise uninterrupted or error-free availability. Maintenance, upgrades, internet failures, third-party outages, abuse controls, security incidents or events beyond reasonable control may affect access.
Halloterra may change, replace or discontinue features. We will use reasonable efforts to give advance notice where a material change substantially reduces a paid core feature during an active paid period, unless urgent security, legal or third-party circumstances make advance notice impracticable.
18. Suspension and termination
Halloterra may suspend or restrict access where reasonably necessary to protect the service, users or third parties; investigate suspected fraud or abuse; comply with law; respond to a security risk; enforce plan limits; or address overdue amounts or a breach of these Terms.
For a remediable breach, Halloterra will ordinarily give notice and a reasonable opportunity to remedy before termination. Immediate suspension or termination may occur for serious illegality, fraud, security abuse, repeated infringement, threats of harm or conduct likely to expose Halloterra, Paddle, a provider or another person to material risk.
The Customer may stop using the service and cancel recurring renewal as described above. Termination does not erase payment obligations already incurred.
19. Data export and deletion
Customers should maintain their own copies of important Customer Content and export available data before expiry or termination.
After an account or plan ends, Halloterra may retain Customer Content for a reasonable operational recovery period and may then delete or de-identify it, subject to backups, legal retention duties, disputes and any written enterprise agreement. Halloterra does not guarantee that expired or terminated content can be restored.
Following account closure or termination, or the end of an expired plan that is not reactivated, Customer Content will ordinarily remain eligible for recovery for up to 90 days. After that recovery period, Halloterra may permanently delete or de-identify Customer Content from active systems without further notice. Residual copies may remain temporarily in secure backups until overwritten in the ordinary course and will not ordinarily be restored except for disaster recovery, security, legal or compliance purposes.
20. Warranties and disclaimers
Each party warrants that it has authority to enter into the agreement.
To the maximum extent permitted by law, the service is provided on an "as available" basis. Halloterra does not warrant that the service, Customer Content, third-party data or generated output will be uninterrupted, error-free, complete, accurate, fit for a particular purpose or suitable for safety-critical use.
No statement excludes a warranty or remedy that applicable law does not permit Halloterra to exclude.
21. Limitation of liability
To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, exemplary, punitive or consequential loss, or for loss of profit, revenue, goodwill, anticipated savings or data, arising from the service or agreement, even if advised that such loss was possible.
To the maximum extent permitted by law, Halloterra's total aggregate liability arising from the service or agreement during any twelve-month period is limited to the fees paid or payable for the affected Amigomap service during the twelve months preceding the event giving rise to the claim.
The exclusions and cap do not apply to liability that cannot lawfully be limited, including fraud or wilful misconduct, and do not reduce any mandatory consumer remedy.
22. Indemnity
To the extent permitted by law, the Customer will defend and indemnify Halloterra and its personnel against third-party claims, losses and reasonable costs arising from Customer Content, the Customer's event or business operations, its unlawful use of the service, or its breach of sections 9, 10, 11, 12 or 16, except to the extent caused by Halloterra's breach, negligence or wilful misconduct.
23. Mandatory rights and fair interpretation
These Terms must be interpreted subject to applicable law. A clause is not intended to exclude liability or a right where exclusion is prohibited. If a clause is invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining clauses continue.
24. Governing law and disputes
The agreement is governed by the laws of the Republic of South Africa, without regard to conflict-of-law rules.
Before court proceedings, the parties will attempt in good faith to resolve a dispute through written notice and discussion for at least 20 business days, unless urgent relief is reasonably required.
Subject to mandatory law, the courts with jurisdiction in Cape Town, Western Cape, South Africa have exclusive jurisdiction. A consumer may retain any right to bring a claim in another forum that applicable law makes mandatory.
25. Changes to these Terms
Halloterra may update these Terms. Material changes will be notified through the service, website or email within a reasonable period before taking effect, where practicable. Continued use after the effective date constitutes acceptance, but a Customer may cancel a recurring subscription before renewal if it does not accept a material change.

Notices to Halloterra must be sent to legal@amigomap.com and, where formal service is required, to 184 Upper Buitenkant Street, Oranjezicht, Cape Town, 8001, South Africa.
Halloterra may send notices to the email address associated with the Customer account or display them in the service. The Customer must keep contact details current.
27. General
The Customer may not assign the agreement without Halloterra's written consent, except as part of a genuine merger, reorganisation or sale of substantially all of its business, provided the assignee is not a competitor and can perform the obligations. Halloterra may assign the agreement as part of a corporate restructuring, financing, merger or sale of its business or assets.
Neither party is liable for delay caused by events beyond its reasonable control, except for payment obligations already due.
These Terms, the order or checkout, the Privacy Policy, Acceptable Use Policy and Refund and Cancellation Policy constitute the agreement concerning the service, unless a signed order form or data-processing addendum adds terms.
